Our covering conditions
for the breeding season 2026
The breeder (the “Breeder”) who orders and buys for a mare semen from a stallion stationed at the stallion station Klosterhof Medingen (the “Station”) or semen from another stallion available at the Station and/or brings the mare to the Station to have her inseminated and/or leaves the mare for an insemination at the Klosterhof Medingen accepts the following general terms and conditions (the “Breeding Conditions”) of the operator of the Station, Christoph Wahler:
Additionally, the general terms and conditions of the respective breeding associations or coverings shall apply.
1. The covering season starts on February 1st and ends on August 15th.
2. We request your order by phone (+49 (0) 5821 98 68 19) or by e-mail (deckstation@klosterhof-medingen.de). To have the semen delivered the following day, the complete order of the semen has to come in at the Station Monday to Friday by 10.00 a.m. and on Saturdays by 9:00 a.m. CET at latest. The Station is not able to ensure a timely delivery for any orders coming in later than this. We are pleased to receive pre-orders. Shipments on weekends are possible after prior consultation of the Station’s office, the Breeder bears the additional shipment costs. The shipment on bank holidays is not possible. Subject to prior consultation of the Station’s office the ordered semen can be collected at the Station.
The order of the semen shall include the following information:
· Name of the requested stallion,
· type of semen (fresh or frozen),
· the Breeder’s name and full address (as owner of the mare) incl. phone number and email address,
· membership number of the breeding association for the transfer of the cover certificate,
· shipping address for the semen,
· name and full address of the administering veterinarian incl. phone number and email address,
· specifications of the mare: Name, life number, pedigree, age, color, markings and branding (if any) and breeding association,
· splitting of the stud fee: yes or no,
· embryo transfer: yes or no.
Before the first insemination the Breeder shall disclose if he intends to conduct an embryo transfer. The stud fee is payable for every flushed embryo.
By placing the order, the Breeder confirms that he is at least 18 years old and fully legally competent, and that he has read and accepted the Breeding Conditions and agrees to the storage and use of his data.
The Breeder’s order of the semen is a contractual offer. The contract is closed by the Station’s acceptance of the offer. The acceptance can be in oral, written or electronic form.
3. The stud fee is determined according to the information provided by the Station regarding the respective available stallion (e.g., stallion catalog, Klosterhof Medingen website). All prices for semen are considered with a plus of 7% VAT or the applicable tax rate.
For each stallion available through the Station, the stud fee can be split into two installments. The amount of each installment varies depending on the stallion and is determined by the Station's information for that particular stallion. The first installment is due upon ordering the semen, and the second installment is due upon confirmation of the mare's pregnancy. The breeder is obligated to inform the breeding station of the pregnancy immediately.
Breeders who pay the full stud fee upon ordering receive a 10% discount on the net stud fee. In the event of non-pregnancy, the regulations under section 9 apply.
The Breeder bears the shipping costs including the costs for delivery of the semen from other stallion stations to the Station.
The stud fee is payable in advance by Breeders located outside of Germany and/or those having semen shipped abroad.
The health certificates (traces) required under EU animal breeding regulations for semen shipments abroad must be requested separately from the Station. The Breeder is responsible for the costs of these health certificates.
The Station has fulfilled its contractual obligations for the shipment of the semen with the handover of the transportable packed semen to the shipping contractor. The transfer of risk acc. to § 446 of the German Civil Code (BGB) to the Breeder takes place with the handover.
4. If the Breeder uses the ordered semen in an unauthorized manner (e.g. insemination of non-registered mares, non-report of a successful embryo transfer etc.), the Station has the right to charge a contractual penalty of 2,500.00 € (two thousand five hundred Euro) additional to any outstanding amounts and further claims by the Station.
5. The Breeder shall send the shipping containers immediately after receipt sufficiently stamped back to the Station. The lending fee for a shipping container for deep frozen semen is 100.00 € (one hundred Euro). For shipping containers for fresh semen no lending fee is due. If the Breeder does not immediately send back the containers to the Station, the Station has the right to charge the Breeder 35.00 € (thirty-five Euro) per container for fresh semen and 2,500.00 € (two thousand five hundred Euro) per container for deep frozen semen.
6. The Breeder shall submit the applicable breeding certificates (Deckscheine) issued by the breeding association to the Station by the beginning of the breeding season. The Station’s submission of the breeding certificates to the applicable breeding associations is subject to the full payment of the invoiced stud fee and all further costs incurred in connection with the ordered semen and possible insemination (veterinarian, shipment, stable fee etc.). An additional service fee of 20.00 € (twenty Euro) per breeding certificate is charged if the Breeder submits the breeding certificate after August 1st.
7. If the requested stallion is taking part in a tournament, frozen semen will be used. Please contact the office of the Station to ask for the special conditions for frozen semen.
Stallions, especially young stallions, who are covering in their first season, will be registered in the stallion book I (Hengstbuch I) after completion and pass of the stallion performance test. The foals of any of these stallions can only be fully registered if the stallion is registered in the stallion book I. If a stallion is not registered in the stallion book I, the corresponding breeding association can only issue a certificate of birth for the foal. The Station does not represent or warrant that a non-registered stallion will be registered in the stallion book I. The Station is not obliged or responsible to achieve a registration of their stallion in the stallion book I. The Breeder bears the entire risk.
The Station reserves its right to limit the sale of any semen from highly frequented stallions per oestrus/mare or to inseminate the mares on its EU-insemination-station at the Klosterhof Medingen.
The Breeder has no right for a refund of the stud fee if a stallion drops out during the breeding season. The paid stud fee can be charged to the stud fee of another Station’s stallion.
8. The daily rate for accommodation of a mare without foal brought to the Station for insemination is 20.00 € (twenty Euro) add 7% VAT and for a mare with foal 25.00 € (twenty-five Euro) add 7% VAT. When the mare is successfully inseminated or the gestation has been asserted by a veterinarian, the daily rate rises to 30.00 € (thirty Euro) add 7% VAT and 35.00 € (thirty-five Euro) add 7% VAT for a mare with foal. The Breeder agrees on the consultation of a veterinarian at his costs. The accommodation is at the mares’ owner’s risk. All mares have to undergo cervical testing during her oestrus and are required for mares that have refoaled, not picked up or have not foaled „normally“ in the previous season. Medical attendant is Dr. med. vet. Bernhard Ekrod or any other vet chosen by the Station.
9. For mares that did not conceive or resorb the embryo and are inseminated again by a stallion from the Station in the following breeding season, half of the stud fee paid in the previous year will be credited towards the new stud fee for semen in the following breeding season, provided the Station receives a veterinary certificate confirming the mare's non-pregnancy by December 1st. Mares that were inseminated for the first time after July 1st of the respective year and did not become pregnant will receive the full stud fee credited towards the new stud fee in the following year, provided they are inseminated again by a stallion from the Station. The veterinary certificate must also be submitted to the Station by December 1st. If the corresponding veterinary certificate is not received by the aforementioned date, no credit towards the new stud fee is possible. These crediting regulations do not apply to frozen semen.
10. Christoph Wahler is not liable for claims arising from the sales contract for semen or any insemination or mare’s accommodation contract and the shipping of the semen (incl. delays, shipping damages etc.). This exclusion of liability does not apply in the following cases:
· damages caused by an act of gross negligence Christoph Wahler, his legal representative or vicarious agent,
· damages at least based on a slightly negligent breach of essential contractual obligations (cardinal obligations) on the part of Christoph Wahler, but the amount is limited to the damage that is foreseeable and typical for the contract at the time of the conclusion of the contract,
· personal injury resulting from damages to life, body or health at least based on a negligent breach of duty by Christoph Wahler, his legal representative or vicarious agent.
The exclusion of liability also applies to damages which are caused during the mare’s accommodation and during all procedures which are necessary for the insemination of the mare. Christoph Wahler is not liable for damages caused by a third party which is not his legal representative or vicarious agent.
The owner of the mare shall effect an indemnity insurance to cover the risks of liability as an animal owner and to prove upon the Station’s request.
11. The stallions at the Station can be viewed by prior appointment. The Station’s office is open on weekends from 7:30 am to 12:00 pm.
For breeding advice and questions regarding boarded mares, a member of the Station’s staff is available Monday to Friday from 3:00 p.m. to 6:00 p.m.
12. The property rights and copyrights are reserved for all images, videos, drawings, descriptions and other documents used at the Station (incl. the stallion’s catalogue). Sharing them with third parties needs the advanced written consent of the Station.
German law applies to all concluded contracts with the Breeder (incl. acquisition of the semen, insemination, accommodation of a mare etc.) and these Breeding Conditions. The Breeding Conditions are available in German and English. In case of contradictions, the German version alone applies. When interpretations of the English version are needed, the German version is primarily to be used.
Place of fulfilment is Medingen/Bad Bevensen, Germany, and place of jurisdiction is Uelzen, Germany.
Christoph Wahler reserves the right to change or add to these Breeding Conditions for the future. Should individual clauses of these Breeding Conditions are or become ineffective or unfeasible, the validity of the sales contract itself remains unaffected. The ineffective or unfeasible clause is replaced by provisions that come close to the intent of the unfeasible provision.
